Full job description

Solutus Legal Search has been exclusively retained by our client, a leading health and wellness platform that is revolutionizing telehealth for providers and patients alike, in its search for a Senior Counsel, Product.

This attorney will report to the Head Counsel, Product and will serve as a hands-on legal partner responsible for the day-to-day review of marketing claims and promotional materials across the company’s consumer and FDA-regulated product portfolio. This is a highly tactical, execution-oriented role: you will conduct substantive claim reviews, provide legal support for clinical trials and research initiatives, and partner with Regulatory Affairs and other cross-functional teams to build compliance directly into the marketing development process. Sitting at the intersection of product, science, healthcare regulation, and marketing, you will help the business move quickly and responsibly by making sound, practical legal and regulatory judgments in real time.


Responsibilities will include:

  • Conduct tactical, high-volume review of advertising and promotional claims, product labeling, and marketing assets across channels (web, email, social, paid media, and packaging) for compliance with FDA, FTC, and state consumer protection requirements.
  • Evaluate proposed claims for compliance with FDA labeling and promotion requirements, and coordinate with Regulatory Affairs on claim substantiation, off-label risk, and interactions with FDA guidance.
  • Build practical legal tools embedding claim substantiation and consumer protection compliance into the marketing development process.    
  • Serve as a key legal liaison to Regulatory Affairs, Clinical, Quality, Medical, Product, and Marketing on claim and compliance matters and support legal review for clinical trials and research initiatives that inform marketing claims.
  • Partner with cross-functional legal teams to monitor developments in FDA and FTC advertising and promotion, clinical research, and consumer protection law, and translate them into practical, actionable guidance

    • The ideal candidate will have:

  • Juris Doctor from an ABA-accredited law school
  • Active bar membership in at least one US jurisdiction and eligible to practice in house in your state of residence
  • 5+ years of experience practicing at a law firm and/or in-house
  • Substantive experience reviewing advertising and promotional claims, ideally for FDA-regulated products (drugs, devices, cosmetics, or dietary supplements)
  • Working knowledge of FDA and FTC advertising and promotion requirements and claim substantiation standards
  • Ability to make sound, practical judgments quickly in a dynamic, fast-paced environment with shifting priorities
  • Excellent communication and relationship-building skills with cross-functional partners
  • Ability to balance legal risk with business objectives and offer creative, workable solutions
  • Detail-oriented, self-starter mindset and comfort navigating ambiguity and novel legal issues

    • Preferred Qualifications:

  • Experience supporting clinical trials, research, or medical/legal/regulatory (MLR) review
  • In-house experience at a healthcare, pharmaceutical, medical device, consumer health, or telehealth company
  • Familiarity with clinical data and real-world evidence as a basis for claim substantiation
  • Background in consumer goods, health tech, or digital product ecosystems
  • Experience advising on AI-powered products

    Compensation is targeted at an annual base salary range of $215,000 to $255,000, an equity grant, and generous benefits. The total compensation package will vary and depend on the candidate’s level of seniority, number of years of directly relevant experience, and geographic location.
